उत्तर प्रदेश के 1 लाख 17000 होमगार्ड्स के आएंगे अच्छे दिन

 इलाहबाद हाईकोर्ट ने सोमवार को दिया बड़ा फैसला / होमगार्ड्स को पुलिस आरक्षी के एक दिन के वेतन के बराबर भत्ता देने के उत्तर प्रदेश सरकार को दिया निर्देश ♐ हाईकोर्ट ने आर्डर में दिया सुप्रीम कोर्ट द्वारा होमगार्ड्स के पक्ष में दिए गए आदेश का हवाला / हाईकोर्ट ने कानपुर के 6 होमगार्डों द्वारा दायर की गयी रिट संख्या WRIT -A No. -47479 OF 2015 पर दिया फैसला / उत्तर प्रदेश सरकार के सरकारी वकील को 29 सितम्बर 2015 तक सरकार का पक्ष रखने का दिया समय//कानपुर से हाई कोर्ट में रिट करने वाले होमगार्ड्स के नाम – रामनाथ गुप्ता, मनोज कुमार यादव, विष्णुकांत पाण्डेय, विजय सिंह, शकुन्तला शर्मा और माया देवी हैं। जो वर्तमान में कानपुर होमगार्ड्स विभाग में अपनी सेवाएं दे रहे हैं।

Learned Counsel for the petitioners submits that the Uttar Pradesh Home Guards
Act is somewhat similar to the provisions of the Punjab, Delhi and Himachal
Pradesh. He has drawn the attention of the Court to a judgement of the Supreme
Court in the case of Grah Rakshak, Home Guards Wel. Asso. v. State of H.P. &
Ors. (Civil Appeal No. 2759 of 2015 arising out of SLP (C) No. 12858 of 2009,
decided on 11 March 2015. In those cases the Supreme Court has issued directions
to the State Government to pay them the duty allowance at such rates, total of
which 30 days (a month) comes to minimum of the pay to which the police
personnel of State are entitled. Relevant part of the order reads as under:
“22. In view of the discussion made above, no relief can be
granted to the appellants either regularization of services or
grant of regular appointments hence no interference is called for
against the judgments passed by the Himachal Pradesh, Punjab and
Delhi High Courts. However, taking into consideration the fact
that Home Guards are used during the emergency and for other
purposes and at the time of their duty they are empowered with
the power of police personnel, we are of the view that the State
Government should pay them the duty allowance at such rates,
total of which 30 days (a month) comes to minimum of the pay to
which the police personnel of State are entitled. It is expected
that the State Governments shall pass appropriate orders in terms
of aforesaid observation on an early date preferably within three
months.”
Learned Standing Counsel may take instructions in the matter from the State
Government about the stand taken by the State of U.P. in respect of the said
direction.
Put up this case on 29 September 2015 in the additional cause list. On that date,
learned Counsel for the petitioners would be at liberty to make a mention to take up
the case out of turn.
